Background Check Positive Return Policy and Procedure
|
|
How to Do:
Procedure to followed by School of Education (SoE) faculty if a Tennessee Bureau of Investigation Child-related worker private background check report returns with an "indication that there is reason to preclude the applicant from consideration for employment or licensing" regarding a School of Education candidate.

Upon the return of the record showing incident(s), contact the court in which the trial was heard. General sessions court in Lebanon -- 444-2045. |

If the background check indicates that the case was dismissed, contact the candidate anyway and follow steps 2-5. |
| 2. |
Candidates whose records show some past criminal activity must immediately meet with the Coordinator of Field Experiences (CFE), and are not to visit or return to the schools at which they have been placed until the following steps have been taken . |
| 3. |
CFE must document meeting and discussion. A copy of documentation must be kept in the candidate's file in the SoE office. |
| 4. |
Candidate must fill out a statement on the incident, including details on the court case and sentencing. |
| 5. |
CFE considers the case with the criteria below in mind. CFE decides yea or nay on allowing candidate to continue with their placement or be placed in a school. |
| a. |
After reviewing the statements and the record, if we feel that they are not a danger to children we must document our rationale for approving them to continue with their placement in a school. This must also be kept in the candidate's file in the SoE office. |
| b. |
That documentation is to be filed with the district, and they may consider the case on the merits for themselves weighing our judgment. |
| c. |
If the candidate is cleared, the CFE is responsible for following up with the cooperating teacher(s) after the first visit by the candidate to their classroom(s) and reasonably frequently thereafter. If the cooperating teacher has any doubts about the candidate, they are to be pulled immediately. They will be assisted with a change in major at that point. |
| 6. |
CFE sends meeting report to Dean of School of Education for approval. |
| 7. |
CFE sends a copy of the approved document to the district. |

How to Do:

Any incident involving children, minors, abuse, violence, etc. is to be very seriously considered . |
| 3. |
For other incidents not involving chi ldren or violence} CFE must consider the nature and date of the incident before clearing the candidate for placement. |
IF THE CANDIDATE IS CONSIDERED INELIGIBLE FOR PLACEMENT BY CUI THE SCHOOL OF EDUCATION FACULTY MUST DO ALL THEY CAN TO ASSIST THE CANDIDATE WITH A TRANSFER TO ANOTHER APPROPRIATE MAJOR.
